Consumer Terms and Conditions

Terms and conditions are all too often arcane, over complicated and difficult to follow. At Techu we try to keep things simple and we are confident that you will find ours to be understandable and reassuring. In case of any questions, please don\'t hesitate to contact us.

Our terms and conditions are compliant with the new Distance Selling Regulations and are therefore designed to ensure that all our customers can shop with confidence. It is worthwhile noting that these do not affect your statutory rights as a consumer. To order goods through this web site you must be at least 18 years of age. When you order from us we will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

 

Order Process 

All orders placed are subject to final acceptance by Techu. Following receipt of any order, we may send you an acknowledgement detailing the products which have been ordered. This communication is not an order confirmation or order acceptance. Techu operate a deferred payment scheme, the contract becomes binding only when we accept your offer to buy, which will take place on release of this payment, at which point you will receive a confirmation that goods are awaiting despatch. 99% of orders are despatched and delivered within 5 days, however should you order a product that is not currently in stock, then you will be given an expected delivery date. If no period has been agreed, the limit is 30 days from the day after you place the order. Payment will normally not be taken until the goods have arrived in stock and despatched. If we have notified you that the order has not been accepted, or it has been cancelled by you, then we will arrange a full refund if payment has been taken.

 

Product Information


Product specifications, images and other material published on our website have been provided by manufacturers, suppliers or relevant trade publications. It is our intention to ensure that all information displayed is accurate and up to date. However as specifications are in the most part subject to change without notification by the manufacturer we strongly advise verifying any critical specifications. Further information can be found on the manufacturer\'s websites to which we provide links for all our products.

 

Pricing and Payment


All prices are in £ sterling and are inclusive of VAT and standard delivery within the UK mainland, but exclude any relevant premium delivery charges (for details see "Delivery" below). Payment can be made by any major credit/debit cards via our secure Cadsave payment gateway server, by bank transfer, or where available by finance. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery. Ownership and title of the goods will only pass to the customer upon receipt of full payment. 
 

Product Guarantee


At Techu we are proud to sell the best products in design, quality and value for money. Unfortunately because even the best products can sometimes let you down, we offer a minimum 12 months guarantee on all products, however we can extend your warranty up to a total of 5 years. Our guarantee excludes faults caused by misuse, neglect, accidental damage and software related issues. Batteries, tapes, films and other consumables are also excluded. If your product should fail within the warranty period, please see our DAMAGED or FAULTY GOODS section below. Additional extended warranties purchased from Techu and supplied by Domestic and General may include cover for accidental damage.

Customers are strongly advised to retain the original packaging for a minimum of 14 days as with these we can arrange collection on your behalf, free of charge with our own courier, without these we may require you to return goods to us yourself to ensure they are returned undamaged. Should you wish to return goods within this 14 day period, to Techu period and you do not have the original packaging, then you will need to purchase appropriate and adequate packaging yourself, and return to us via an insured courier service at your cost. Note, goods that arrive in this manner damaged, whether by transit or not, will not be accepted for refund or replacement. 
 

Delivery


Our delivery service is provided by a number of reputable 3rd party courier companies such as TNT Logistics, City-link, Business Post, Parcelforce, Target, Palletline and sometimes private couriers. They are the experts in delivering bulky items such as plasma TVs. Delivery is available throughout the UK including Ireland and Scottish Highlands. If you live within one of the following postcode districts or outside of the UK our premium delivery services may not be available and additional shipping costs may apply. Please refer to our shipping table for details. All deliveries will be door to door only and you might need to assist the driver if required. It is not part of the delivery charge for the driver to be expected to deliver to any room within an address; they would normally only deliver to the ground floor door or garage etc, it is possible however that some drivers will accommodate this but it is not normally part of their contract.

Please note that premium deliveries are offered under separate contract. Any premium paid for a delivery service will be deemed non refundable in the event of goods being returned. 


Product Returns - Your Right to Cancel 


If you wish to exercise your right to cancel your order because you are not satisfied with your purchase of a product, we provide a 14 Days No Quibbles Return Policy. This means that, if for any reason you should wish to return a product (or products) that you have bought from us, you are totally at liberty and within your rights to do so.

In order for us to collect unwanted goods, all products returned MUST be 100% complete and contain ALL the original manuals, blank warranty cards, accessories and any other documentation included with the original shipment. 

Customers should retain all boxes and packaging as goods will not be collected unless in original packaging. Should you still wish to return goods within this 14 day period to Techu then you will need to purchase appropriate and adequate packaging yourself, and return to us via an insured courier service at your cost. 

Note: goods that arrive in this manner damaged, whether by transit or not, will not be accepted for refund. 

Provided that the return meets these conditions then we will give you a full refund of the returned product less any collection expenses. 
 

Products Returns - Damaged in Transit 


If any items are damaged in transit, we require that you report it to us by logging into your account, selecting Returns & Faults, and requesting a Return Merchandise Authorization (RMA) number before goods can be returned to us. In order to make a claim of transit damage against a courier, transit damaged goods must be notified within 48 hours of the delivery, and we will require photographs of the goods and the box. Should goods arrive with damaged packaging you are expected to sign as such on the delivery note, and we strongly advise that you insist on checking the contents prior to acceptance, as you will be otherwise signing that goods have been received in good condition. It is expected that you or your agent will check for visible damage to the packaging prior to acceptance. Goods signed as UNCHECKED where there is obvious visible damage to the packaging may not be accepted for return.

Please ensure you detail on your online Returns & Faults notes how the goods were signed for and whether there was any visible damage to the box when it was delivered.

Items must be ready to be returned with their original packaging where possible, complete with all accessories and documentation.

Damaged goods signed for in good condition may not be accepted for return.

 

Products Returns - Unwanted within 14 days of receipt 


As a consumer you have the right, under the Distance Selling Regulations (EU) 2000., to cancel the contract and receive a refund for your goods if cancelled in writing within 7 days.

However, at Techu we will accept unwanted AV products for refund within 14 days of delivery, but only provided that the goods are complete with all relevant documents, contents and accessories in properly cared for condition. Soiled, damaged or incomplete products will not be accepted.

You must inform us in writing of your request to cancel by logging into your account, selecting Returns & Faults, and requesting a Return Merchandise Authorization (RMA) number before goods can be returned to us. This must be completed within fourteen working days from the day your goods were delivered to you.
All original packaging should be retained for returns/refund/warranty purposes. Should you require Techu to arrange collection of a product you MUST have kept all the original packaging and accessories. If your goods go faulty within 14 days and you have not kept the packaging you will be referred back to the manufacturer for a warranty claim.

 

·  The average delivery cost on a small item is £10 and £45 for larger items and this will be deducted from any goods returned within 14 days of delivery unless products are confirmed faulty.  

 

·  The average delivery cost on all Plasma and LCDs, 40 inches and above in size, is £75 and this shall be deducted from goods returned within 14 days unless products are confirmed faulty.

 

·  The average delivery cost of white goods is £75 one way, customers who return goods within 14 days will be refunded less the delivery charge unless products are confirmed faulty.

 

 


We will offer to collect the goods from you at your cost or you can return the goods to us yourself via an insured courier. Should goods be received back to us damaged it will be your responsibility to claim for the damage from the courier and we will not issue a refund.

Unwanted items returned for refund or exchange, for whatever reason, but within 14 days will NOT be subject to a warehouse re-stocking fee, and you will be refunded the value of the returned item in FULL less the charge from the courier for collecting the goods should you require us to do so.


Products Returns - Faulty within 14 days of receipt 


If any product is to be returned as faulty within the first 14 days of receipt, we require that you report it to us by logging in to your account and requesting a Return Merchandise Authorization (RMA) number before goods can be returned to us.

Any product returned as faulty within the first 14 days of receipt must be assessed by the manufacturer to confirm that it is indeed faulty. This process can take up to 5 working days from collection of the product.

Should a fault be confirmed by the manufacturer then we will offer a full refund or replacement of the product.

For all UK Mainland orders collection and replacement costs will be met in FULL by Techu.

All original packaging should be retained for returns/refund/warranty purposes. Should you require Techu to arrange collection of a product you MUST have kept all the original packaging and accessories. If your goods go faulty within 14 days and you have not kept the packaging you will be required to return the goods using your own courier at your own risk as we will not be able to guarantee safe transit using our own couriers.

If any product develops a fault after the first 14 days since receipt, we require that you report it to us by logging into your account and requesting a Return Merchandise Authorization (RMA) number before goods can be returned to us.

Any product that develops a fault after the first 14 days since receipt of the product then provided your item is within its warranty period, you are entitled to a warranty repair.

We will either handle the servicing ourselves or direct you via one of our authorised agents. This does not apply to faults caused by accident, neglect or misuse for which there can be no refund or exchange and for which you may be liable for costs incurred.

This does not affect your statutory rights. 

Where goods are accepted for return outside the 14 day period, Techu reserves the right to offer a partial refund based on the length of time the consumer benefited from the goods.

You can buy with the confidence that we are continually reviewing our prices to be ahead of our competitors. Our team are constantly monitoring the competition to make sure our prices are always the best. If you do find anything at a lower price elsewhere on the same day of purchase then please contact us immediately. We will do everything to match that other price including like for like delivery. Our price promise excludes opening or closing down offers, ex-display, foreign imports, clearance, special orders, members only or extended warranty prices. 

 

Satisfaction Guaranteed 


Our no quibble 14 day money back guarantee means you can return your purchase if you change your mind. We request that the product has not been used or opened, is returned to us undamaged in the original packaging containing all the original contents and all we ask is that you pay all carriage costs (with insurance). We will arrange collection for you or you can request our appropriate warehouse address and return the goods to us yourself. Goods received back incomplete, soiled or in a damaged or worn condition will be returned to you and the cost of delivery charged to your account. This does not affect your statutory rights as a consumer.

To take advantage of this offer, you must notify us within 14 days of delivery.

 

 

Force Majeure 

Techu will not be under any liability whatsoever in the event that Techu  is prevented from or delayed in supplying or making delivery of any goods by any reason or cause beyond Techu\'s control. Reasons may include but are not limited to war, acts of terrorism, labour disputes, fire, flood, storm, the breakdown of machinery, failure of computer equipment and default of suppliers or couriers.

 

Printing & Pricing Errors 


Prior to payment being taken (ie. the release by Techu of your deferred card payment) and a contract being formed we have the right to refuse or cancel any orders placed in the event a product is listed at a wrong price due to a typographical (human) error or incorrect pricing information received from our suppliers. In the event of a cancellation or refusal of any order we will arrange an immediate and full refund if payment has been made.

 

Security 


When you shop with us via our web site, all your financial transactions are entirely secure. Our secure server software encrypts all your payment card details. The process scrambles all the information, allowing no unauthorised third party to intercept the data. We also use agencies to validate each purchaser really is the legitimate card holder.  

 

Protecting Your Security  


You agree that we may use Personal information provided by you in order to conduct appropriate anti fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

In compliance with UK law, we are registered with the data protection act. For your protection, we also use agencies to validate each purchaser really is the legitimate card holder. We collect information about you for 2 reasons: firstly, to process your order and secondly, to provide you with the best possible service.

Your Personal Information may be disclosed to reputable third parties who will help process your order or provide after-sales service. Techu requires all such third parties to treat your personal information as fully confidential and to fully comply with all applicable UK Data Protection and consumer legislation from time to time in place. 

We will not e-mail you in the future unless you have given us your consent.

We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. Techu for business

THE FOLLOWING ADDITIONAL TERMS AND CONDITIONS ARE APPLICABLE FOR PURCHASES BOUGHT FOR PURPOSES OF TRADE, RESALE, PROFESSION OR BUSINESS


 

 

B1.0 DELIVERY

B1.1 Delivery of the Products shall be made to the Customers business address or any other address nominated by the customer with the prior agreement of Techu ltd.


B2.0 PRODUCTS PURCHASED ON CREDIT TERMS

B2.1 In relation to any Products purchased by the Customer using any credit facility granted by the Seller, the buyer shall provide a signed official purchase order and the Seller shall issue an invoice for payment with the Products. 


B2.2 The Customer shall pay any invoice within 7 days of receipt unless otherwise agreed.

No payment nor transferral of ownership shall be deemed to have been received until the Seller has received cleared funds.


B2.3 The Customer shall make all payments due under the Contract in full without any deduction whether by way of set-off, counter-claim, discount, abatement or otherwise unless the Customer has a valid court order requiring an amount equal to such deduction to be paid by the Seller to the Customer.


B2.4 If the Customer fails to pay the Seller any sum due pursuant to the Contract, the Customer shall be liable to pay interest to the Seller on such sum from the due date for payment at the annual rate of 8% above the base lending rate from time to time of the Bank of England, accruing on a daily basis until payment is made, whether before or after any judgement. The Seller reserves the right to claim interest under the Late Payment of Commercial Debts (Interest) Act 1998.

Full legal and beneficial title and ownership of the Products shall only pass to the Customer when the Seller has received in full (in cash or cleared funds) all sums due to it in respect of:

B2.4.1 The Products; and

B2.4.2 All other sums which are or which become due to the Seller from the Customer under any other contract or account.

B2.5 Until title and ownership of the Products has passed to the Customer, the Customer shall:

B2.5.1 Hold the Products on a fiduciary basis as the Seller\'s bailee;

B2.5.2 Store the Products (at no cost to the Seller) separately from all other Products of the Customer or any third party in such a way that they remain readily identifiable as the Seller\'s property;

B2.5.3 Not destroy, deface or obscure any identifying mark or packaging on or relating to the Products; and

B2.5.4 Maintain the Products in satisfactory condition and keep them insured on the Seller\'s behalf for their full price against all risks to the reasonable satisfaction of the Seller. On request the Customer shall produce the policy of insurance to the Seller.

 

B2.6 The Customer\'s right to possession of the Products shall terminate immediately if title and ownership of the Products has not already passed in accordance with condition B.2.4. and:

B2.6.1 The Customer has a bankruptcy order made against him or makes an arrangement or composition with his creditors, or otherwise takes the benefit of any statutory provision for the time being in force for the relief of insolvent debtors, or (being a body corporate) convenes a meeting of creditors (whether formal or informal), or enters into liquidation (whether voluntary or compulsory) except a solvent voluntary liquidation for the purpose only of reconstruction or amalgamation of the Customer; or

B2.6.2 The Customer suffers or allows any execution, whether legal or equitable, to be levied on his/its property or obtained against him/it, or fails to observe or perform any of his/its obligations under any contract between the Seller and the Customer, or is unable to pay its debts within the meaning of section 123 of the Insolvency Act 1986 or the Customer ceases to trade; or

B2.6.3 The Customer encumbers or in any way charges any of the Products.

B2.7 The Seller shall be entitled to recover payment for the Products notwithstanding that legal and beneficial ownership and title of any of the Products has not passed from the Seller.

B2.8 The Customer grants the Seller, its agents and employees an irrevocable licence at any time to enter any premises where the Products are or may be stored in order to inspect them, or, where the Customer\'s right to possession has terminated, to recover them.


B3.0 QUALITY

B3.1 The Seller is a re-seller and not a manufacturer of the Products. In this respect and to the fullest extent permissible by law, the Seller is unable to offer any express warranties of any kind whatsoever in respect of the Products.

B3.2 Save to the extent that any exclusion or restriction of liability may be prohibited by statute, all implied warranties relating to the Products (statutory or otherwise) including (without limitation) any warranties relating to quality or fitness for a particular purpose, shall be fully excluded.

B3.3 The Products may be sold with a manufactures warranty, details of which shall be dispatched with the Products.

B3.4 Products which are found to be defective following delivery shall be dealt with by the Customer in accordance with any subsisting manufacturer\'s warranty. For the avoidance of doubt, this may mean that the Products are repaired as opposed to replaced and must be returned directly to the manufacturer as opposed to the Seller.




B4.0 CANCELLATION RIGHTS

B4.1 The 14 day no quibbles return policy, and right to cancel described in section entitled Product Returns - Your Right to CancelTESTshall not apply. For the avoidance of doubt, the Consumer Protection (Distance Selling) Regulations 2000 do not apply to the sale of Products in the course of a trade, business or profession.

 

 

B5.0 RETURNS

B5.1 Subject to the Sellers written agreement and the payment of a re-stocking charge (which is 25% of the purchase price) by the Customer, the Products may be returned at the expense of the Customer within 7 days of delivery.
